These Terms of Service ("Terms") govern your access to and use of Dusklight, including the Dusklight website, companion services, subscription features, voice features, memory features, and related services collectively referred to as the "Service."
Dusklight is operated by Jenna Robertson, a sole proprietor doing business as Dusklight ("Dusklight," "we," "us," or "our").
By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Dusklight is intended exclusively for adults who are at least 18 years old.
By accessing or using the Service, you represent and warrant that:

You may not allow a minor to access your account or use the Service. We may suspend or permanently terminate any account that we reasonably believe belongs to, is being accessed by, or is being used for the benefit of a person under 18.
Dusklight provides AI-generated companion conversations and related features. Depending on your account and subscription level, the Service may include:

Dusklight companions are artificial intelligence systems. They are not human beings, licensed professionals, medical providers, therapists, attorneys, financial advisers, emergency responders, or representatives capable of forming legal obligations on behalf of Dusklight.

You are responsible for evaluating AI-generated content before relying on it or acting on it.
You must not use the Service as a substitute for professional medical, mental-health, legal, financial, emergency, or other qualified advice.
Dusklight does not guarantee that a companion will always remember information correctly, preserve a particular personality, respond in a particular style, or remain completely consistent across messages, models, updates, or service interruptions.
You must create an account to use certain features.

You may not sell, transfer, rent, sublicense, or share access to your account.
We may refuse registration, require additional verification, or limit the number of accounts associated with a person, device, payment method, or email address.
The Service may store conversation history and companion memories to support continuity and personalization.
AI-generated memories may occasionally be inaccurate, incomplete, duplicated, or associated with the wrong person or event. You are responsible for reviewing and correcting important information.
Deleting an individual message may not automatically remove every memory derived from that message unless the Service expressly states otherwise.
You may delete your account and associated data as described in the Privacy Policy and through the available account-deletion tools.
"User Content" means messages, prompts, profile information, images, voice notes, documents, knowledge-library materials, companion instructions, and other content you submit through the Service.
You retain ownership of your User Content.
By submitting User Content, you grant Dusklight a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, process, modify, and display that content only as reasonably necessary to:
This license ends when the relevant content is deleted from our active systems, except where limited retention is reasonably necessary for backups, security, fraud prevention, payment records, dispute resolution, or legal compliance.
You represent and warrant that:
You may not use the Service to engage in illegal, exploitative, abusive, fraudulent, dangerous, or harmful conduct.
Without limiting that rule, you may not use the Service to:
The fact that content is fictional, AI-generated, roleplayed, or privately requested does not make otherwise prohibited content permissible.
We may remove content, block requests, preserve relevant evidence, suspend accounts, terminate accounts, or report conduct to appropriate authorities when we reasonably believe it is necessary to protect users, the Service, or others, or to comply with law.
Dusklight may permit consensual adult fictional content for verified adult users, subject to these Terms and applicable law.
You are solely responsible for the content you request, submit, create, save, or share.
Permission to access adult-oriented features does not permit content involving minors, exploitation, abuse, unlawful conduct, non-consensual intimate material, or violations of another person's rights.
We may establish additional restrictions for particular models, providers, features, jurisdictions, or payment methods.
Some features require a paid subscription or other purchase.
Prices, included features, message limits, storage allowances, fair-use limits, renewal periods, and billing terms will be disclosed at or before purchase.
Payments may be processed by third-party payment processors. Your payment information is also governed by the processor's terms and privacy practices.
You authorize us and our payment processor to charge the payment method you provide for purchases, applicable taxes, and recurring subscription fees.
Automatic renewal
Unless otherwise stated at purchase, paid subscriptions automatically renew at the end of each
billing period until canceled.
Before you subscribe, we will disclose:
You authorize recurring charges until you cancel the subscription.
Cancellation
You may cancel through the account or billing settings made available by Dusklight or through
the payment processor used for your subscription.
Cancellation prevents future renewal charges. Unless otherwise stated or required by law, you will generally retain paid access until the end of the billing period you have already purchased.
Deleting the application, leaving the website, or ceasing to use the Service does not necessarily cancel a paid subscription.
Refunds
Payments are generally non-refundable except:
Ending use early, failing to use included features, dissatisfaction with an AI-generated response, or account termination for violating these Terms does not automatically entitle you to a refund.
Taxes and payment disputes
You are responsible for applicable taxes unless they are collected as part of the transaction.
Contact us before initiating a chargeback so we have an opportunity to investigate billing issues. Fraudulent or abusive chargebacks may result in account suspension or termination.
A feature described as "unlimited" may remain subject to reasonable fair-use, security, anti-abuse, model-provider, technical, and capacity limitations.
We may temporarily slow, queue, restrict, or suspend unusually intensive usage when reasonably necessary to:
We will not use fair-use limitations solely to deny ordinary personal use of a paid feature advertised as unlimited.
Dusklight relies on third-party services that may include:
Your content may be transmitted to these providers when necessary to perform a feature you request.
Third-party services are governed by their own terms, policies, technical limitations, and availability. We are not responsible for third-party outages, policy changes, model behavior, processing delays, or discontinued services beyond our reasonable control.
The Service, including its software, interface, branding, designs, logos, documentation, and original site content, is owned by Dusklight or its licensors and is protected by applicable intellectual-property laws.
These Terms give you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for lawful purposes.
These Terms do not transfer ownership of Dusklight's software, systems, branding, or other intellectual property to you.
You may not copy, modify, distribute, sell, sublicense, reverse engineer, or commercially exploit protected portions of the Service except with our written permission or where applicable law expressly permits it.
If you voluntarily provide ideas, suggestions, bug reports, or other feedback, you grant us permission to use that feedback without restriction or compensation.
This does not grant us ownership of your private conversations, companion content, or other User Content.
We may add, modify, suspend, or discontinue features.
We do not guarantee that:
We may perform maintenance, deploy updates, respond to outages, or restrict access when reasonably necessary.
If we discontinue a material paid feature, we may provide an alternative, account credit, prorated refund, or other remedy where appropriate or required by law.
You may stop using the Service or delete your account at any time.
We may limit, suspend, or terminate access if we reasonably believe:
When appropriate, we may provide notice or an opportunity to appeal. We are not required to provide advance notice when immediate action is reasonably necessary to prevent harm, preserve evidence, comply with law, or protect the Service.
Sections that by their nature should survive termination will remain effective, including provisions concerning ownership, payment obligations, disclaimers, liability, indemnification, and disputes.

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law principles.
Any dispute that is not resolved informally must be brought in the state or federal courts located in Multnomah County, Oregon, and you consent to the jurisdiction of those courts, except where applicable consumer law gives you the right to bring a claim elsewhere.
Before filing a legal claim, you agree to contact us and make a good-faith effort to resolve the dispute informally for at least 30 days.
Nothing in this section prevents either party from seeking urgent injunctive relief or filing an eligible claim in small-claims court.
You may have consumer rights under the laws of your state, country, or region that cannot be waived by contract.
Nothing in these Terms limits rights or remedies that applicable law does not allow us to limit.

You may not assign these Terms or transfer your account without our written permission. We may assign these Terms as part of a merger, acquisition, restructuring, asset transfer, or change in business organization.
These Terms, together with the Privacy Policy and any purchase-specific terms shown to you, form the entire agreement between you and Dusklight concerning the Service.
